NumNinja Terms of Service

Personal Use License: CareCode Labs grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use NumNinja for personal, non-commercial educational purposes only. This license is subject to your compliance with these Terms.

Restrictions: You may not: (a) modify, adapt, translate, or create derivative works based on the App; (b) reverse engineer, decompile, disassemble, or attempt to derive the source code of the App; (c) rent, lease, lend, sell, redistribute, or sublicense the App; (d) remove, alter, or obscure any proprietary notices on the App; (e) use the App for any commercial purpose without explicit written permission.

Educational Institutions: Schools, tutoring centers, and educational institutions wishing to use NumNinja in a commercial or organizational capacity must contact us for proper licensing arrangements.

All content, features, functionality, design elements, game mechanics, educational content, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code contained in NumNinja are owned by CareCode Labs or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The NumNinja name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CareCode Labs. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans in the App are the trademarks of their respective owners.

Supplementary Educational Tool: NumNinja is designed as a supplementary educational tool to help children practice and improve their math skills. It is NOT a substitute for formal education, professional tutoring, or classroom instruction. The App should be used alongside traditional educational methods and school curriculum.

No Educational Guarantees: While we strive to provide accurate, beneficial, and age-appropriate educational content, we make no guarantees about specific learning outcomes, academic improvement, test score increases, or educational achievement. Success in the App does not guarantee academic success in school or standardized tests.

Individual Results May Vary: Every child learns differently. Performance metrics, difficulty assessments, and progress indicators in the App are algorithmic approximations and may not reflect a child's complete mathematical ability or educational needs. For comprehensive educational assessment and personalized learning plans, consult with qualified educators and teachers.

Supabase Backend (Optional): NumNinja uses Supabase as an optional backend service for global leaderboard functionality. When you create a leaderboard username (entirely optional), your public statistics are stored on Supabase servers. This includes your username, Math Points, rank, streak, accuracy, and game-specific statistics. No personal information, email addresses, or authentication credentials are required or collected.

No Advertising: NumNinja does not display any advertisements and does not use advertising networks. The app is completely ad-free to provide an uninterrupted learning experience. We do not collect or share data with advertising networks or third-party advertisers.

Third-Party Terms: If you choose to use the optional leaderboard feature, your use of Supabase services through the app is subject to Supabase's terms of service and privacy policy. Learn more at supabase.com/privacy.

Your privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using NumNinja, you consent to our data practices as described in the Privacy Policy.

Local Storage: All game progress, statistics, and learning data are stored locally on your device using secure AsyncStorage. No account creation is required for gameplay. The app functions completely offline with full access to all 40+ math games.

Optional Leaderboard Sync: You may optionally create a username to sync your public statistics to global leaderboards via Supabase. This is entirely optional and not required for app functionality. Only public statistics (username, Math Points, rank, streak, accuracy) are synced\u2014no personal information is collected or required.

AS-IS Provision: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR EDUCATIONAL EFFECTIVENESS. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARECODE LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, EDUCATIONAL SETBACKS, OR DAMAGES RESULTING FROM USE OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Data Loss: While we implement security measures and encourage regular backups, we are not responsible for loss of data due to device failure, software bugs, updates, or other technical issues. You are responsible for maintaining backups of important data.

We reserve the right to suspend or terminate your access to NumNinja at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. We may also discontinue the App or any features at any time without liability.

Upon termination, your right to use the App will immediately cease. Termination does not relieve you of any obligations that accrued prior to termination. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You agree to indemnify, defend, and hold harmless CareCode Labs and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable laws or regulations.

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization], except that either party may seek injunctive relief in court for intellectual property infringement.

Class Action Waiver: You agree to resolve disputes with us on an individual basis, and not as part of any class, consolidated, or representative action. There will be no right or authority for any dispute to be brought, heard, or arbitrated as a class action.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and, where appropriate, through in-app notifications or email (if you've provided an email address). Your continued use of NumNinja after changes are posted constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the App immediately. We recommend reviewing these Terms periodically for any changes.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The failure of CareCode Labs to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CareCode Labs regarding the use of NumNinja and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter herein.
